Washington/New Delhi: An ugly ruckus that goes against current form has erupted between New Delhi and Washington over the handcuffing and arrest of an Indian diplomat by US authorities for alleged visa fraud and underpaying a housekeeper she brought from India.

Devyani Khobragade, a 1999-batch IFS officer posted as deputy consul general in New York, was released by a Manhattan court on a $250,000 bond on Thursday evening. On Friday, foreign secretary Sujatha Singh summoned US ambassador Nancy Powell to her office in New Delhi and registered a strong protest over the manner in which the diplomat and a mother of two had been treated. The foreign ministry said India had been shocked and appalled by the action against Khobragade, a diplomat with stints in Pakistan, Afghanistan and Germany.

“India is forcefully taking up with the US the treatment meted out to the arrested diplomat which is not acceptable,” said foreign ministry spokesperson Syed Akbaruddin. “You cannot humiliate a mother of two like that publicly,” he said. “If there are issues of an illegal nature, these will be resolved separately.”
MEA spokesperson Syed Akbaruddin, while criticizing the treatment meted out by US authorities to Indian diplomat Devyani Khobragade, said: “As far as we are concerned this kind of behaviour towards an Indian diplomat is completely unacceptable.”

Khobragade was served the arrest warrant when she was dropping off her daughters to school on Thursday morning. The case is being prosecuted by the Manhattan office of US attorney Preet Bharara, an Indian-American. Indian officials are hoping to resolve the matter through diplomatic channels given the complicated legal background to the case involving courts in India. The matter is expected be taken up with the state department and concerned US entities on Friday.

While Bharara’s office portrayed the Indian diplomat as having fraudulently brought a domestic help from India by promising mandatory US wages ($9.75 per hour) and underpaying her ($3.11 per hour), Indian officials presented a more complicated picture of the case. They said the housekeeper, Sangeeta Richard, has been absconding since June this year, and “in this context the Delhi HC had issued an interim injunction in September to restrain Ms Richards from instituting any actions or proceedings against Dr Khobragade outside India on the terms or conditions of her employment”. The US government had subsequently been requested to locate Ms Richard and facilitate the service of an arrest warrant, issued by the metropolitan magistrate of the south district court in New Delhi under Sections 387, 420 and 120B of the IPC, Indian officials added.

“The US side have been urged to resolve the matter with due sensitivity, taking into account the existing court case in India that has already been brought to their attention by the Government of India, and the diplomatic status of the officer concerned,” the embassy in Washington said.

Ms Khobragade's lawyers argue that with her own salary of $ 4,000 a month, she can hardly pay her help more than that. They also said her arrest on the street, without being given a chance to explain, was "shocking and unprecedented."

diplomats breaking jay walking laws and then claiming diplomatic immunity is far different from crimes like this,,,the USA has good ties with India so for them to arrest these diplomats means the USA had very good evidence they were very guilty,,,

that pretty much describes what took place here she got caught red handed then began making excuses as to why she was should be allowed to do what she did..and still being allowed to explain why she broke the laws she broke would not have have made what she did in this country all ok and cause for the police to say well then h no harm no fowl continue on your way and keep up the good work as her lawyer implied would have happened...at least not in this country

American top officials do everything themselves in their own houses, and feels that diplomats from Asian, South East Asia, African countries are better placed in their own country as they can legally import cheap labour....Though there was a violation of so called some law, the actions by the US govt. were most inappropriate. There is something called as diplomatic immunity and there should be a consideration to the status of the induvidual who was arrested.She could have been served a warrant and made to surrender in a proper manner, humiliation is not acceptable,,,You cant arrest and handcuffed a lady in public street .. is she terrorist ?

Indian should give tit for tat reply to american diplomat ..Arrest the US diplomat on the streets of indian city openly and parade them on the streets to the police station. Put any charges of breaking rules or just Bhopal gas tragedy "Dow Chemicals" related some case. Make that person life miserable till this lady is released fully.

As this formula was used against pakistan too few months back against US envoys..which make obama to jump in to handle the situation lol

Diplomat's arrest: Indian home minister,foreign-minister refuse to meet US delegation

India asks US diplomats to return their IDs

NEW DELHI: India on Tuesday hardened its stance further against the US for the humiliation meted out to its deputy consul general in New York Devyani Khobragade with Union home minister Sushilkumar Shinde and Congress vice-president Rahul refusing to meet a visiting US congressional delegation.

Home ministry officials said Shinde is busy in Parliament and, hence, he will not be in a position to meet the American delegation.

However, the home minister's programme, which was prepared on Monday evening, had clearly mentioned the scheduled meeting at 5pm.
Officials said the meeting was cancelled on Tuesday morning.

Gujarat chief minister Narendra Modi has also refused to meet the visiting US delegation.

"Refused to meet the visiting USA delegation in solidarity with our nation, protesting ill-treatment meted to our lady diplomat in USA," tweeted the BJP's prime ministerial candidate.

Meanwhile, India has asked US to return all ID cards issued to their consular officers posted in the country, the PTI reported quoting government sources.

Earlier, the US virtually justified the reported strip-search by New York police of Indian diplomat Devyani Khobragade, saying "standard procedures" have been followed during her arrest.

"Diplomatic security, which is under the state department purview, followed standard procedures during her arrest," state department deputy spokesperson Marie Harf told reporters at her daily news conference.

Harf was asked about media reports that 39-year-old Khobragade, the deputy consul general at New York, was strip-searched and confined with drug addicts after her detention. Media reports also said she was subjected to DNA swabbing.

On Monday, Indian Lok Sabha Speaker Meira Kumar and NSA Shivshankar Menon had refused to meet the delegation in retaliation against the US move.

Sources confirmed that the government made it a point to convey to the delegation that the Speaker was not going to receive them because she had been deeply troubled by the manner in which Khobragade, who is accused of visa fraud, had been dealt with by the US authorities.

Diplomatic immunity and privileges between party countries are regulated by Geneva Convention. Unless being criminal (murder, manslaughter, aggravated (armed) burglary, actively involved in, or armed in a terrorist operation (spy diplomats in bond movies!) they can not be handcuffed or deprived physically in any manner regardless of the nature of the accusation.

Here is a typical example of dominance over the weaker party from which is the most common international law conflicts arise.

India is not denying that she was seized in red hand, Its objection is the treatment she was exposed to.

India “If there are issues of an illegal nature, these will be resolved separately.”

Unfortunately, the US have done many similar unforgettable and unforgivable similar practices in international military and diplomacy law.

she wantingly broke the laws of the land in the country she was a diplomat in and..... what she did would be wrong and be breaking the law in all countries... diplomatic immunity is so diplomats do not get harassed...it was never and never has been a reason nor an excuse or an alibi to be a criminal or a get out of jail free card for someone who chooses to do criminal activities

Wait, so this Indian diplomat was charged with employment offences and pay abuse of an indian worker, and the Indian Government instead of condemning her, decides to engage the US in some diplomatic row? Well done.....

I read somewhere else this diplomat is an advocate for women's rights, and she does this to another woman from her own country? Fucking hypocrite if this is found to be true.

On Tuesday the IFS Offi cers’ Association met to ramp up pressure on the government to consider further retaliatory action if Washington did not offer an unconditional apology.
In her email, Khobragade implored the government to ensure her and her children’s safety and preserve the dignity of the IFS, which was “unquestionably under siege’’. She said she broke down several times but tried to maintain her dignity and composure as she was representing her country.
“While I was going through it, although I must admit that I broke down many times as the indignities of repeated handcuffing, stripping and cavity searches, swabbing, in a holdup with common criminals and drug addicts were all being imposed upon me despite my incessant assertions of immunity, I got the strength to regain composure and remain dignified thinking that I must represent all of my colleagues and my country with confidence and pride,”

The Association believes the US authorities paid no attention to the fact that she was a senior consular officer and that India should treat her American counterparts here in the same manner.
India has been angered by the US state department response which insists that Khobragade does not have immunity under the Vienna Convention on Consular Relations (VCCR). India has pointed to Article 41 of the VCCR which says that if proceedings have to be carried out against a consular official, it must be “with the respect due to him by reason of his official position’’.

This situation is a conspiracy, says External affairs minister

External affair minister Khurshid has said that the entire situation is a conspiracy, and that there is a long history to the incident.

He says that the domestic maid at the centre of the entire controversy went 'missing' and the entire incident was part of a conspiracy that would allow her to immigrate to the US.

He says that India had already registered an FIR against the domestic help as she wanted to illegally immigrate to the US. He also said that the husband filed complaint with the The New York City Police Department (NYPD) of theft of cash, phone, documents against the domestic help earlier, but she had gone 'missing'.

"India had written to NYPD to arrest domestic help so that she can be tried here, but no action was taken", he said, adding that it was in the midst of all this, that the arrest of Devyani was carried out.

Khurshid is also detailing the measures that India is taking against the US in protest at its behaviour in this matter.

This includes directives for US to return diplomatic ID cards and stop diplomatic import clearances. "I don't think that such actions have ever been carried out before", he said to anger from the house, who were falling over each other to tell him that this was also the first time that such an outrageous incident had taken place.

New Delhi: L’affaire Devyani Khobragade has escalated into a full-blown diplomatic spat between India and the US. Stung by the humiliating treatment meted out to India’s deputy consul general in New York, New Delhi on Tuesday upped the ante by taking a series of steps, including withdrawal of certain privileges from American diplomats, removing barricades around the US embassy and seeking information on wages paid to Indians employed by the US embassy and the American School.
As political parties, cutting across party lines, condemned the US action, New Delhi unveiled a series of retaliatory actions which showed a rare hardened attitude towards Washington. This was in sharp contrast to its weak-kneed response to previous slights by the US, the latest being the response to phone tapping by the Americans of the Indian mission in Washington.
On Tuesday, India demanded an unconditional apology for the humiliation of its diplomat, who was strip-searched, handcuffed, her DNA swab taken and bunged in a lock-up with drug addicts and common criminals. We have put in motion what we believe would be an effective way of addressing the issue but also (put) in motion such steps that need to be taken to protect her dignity,” he told reporters here.
The identity cards of all US officials serving in the Mumbai, Kolkata, Chennai and Hyderabad consulates have been withdrawn, which means they will become ordinary foreign nationals rather than those with diplomatic status. Indian officials in consulates in the US are not given such ID cards, which can be used to claim immunity from the police. Special airport passes for American diplomats have also been withdrawn. Aviation authorities have been told to ensure that US embassy vehicles do not get any priority treatment at reserved parking lots at airports across the country.
The most demonstrative action was removal of barricades from the road that runs behind the US embassy here. Bulldozers arrived on Tuesday afternoon to push away concrete barricades from the road, which serves as the entry for visa seekers and had been closed to all traffic. The reason cited for this was denial of designated parking space for the Indian embassy in Washington in January this year.
The Indian government has asked for details of family members of US officials in India, their bank accounts and whether they are employed in any capacity. Indian officials’ spouses or family members in Washington have to seek special permission from the State Department if they want to work outside.

The government has also asked for salary and bank account details of all Indians working for the US embassy and its consulates, including teachers and staff employed in the American Embassy School. It wants to demonstrate that unequal pay is a part of the US’ own practices. “We are going to insist on strict reciprocity,” said foreign ministry officials.

India has also withdrawn tax exemption facility for US diplomats to import and export items.

This facility has been frequently misused by many members of the diplomatic corps of all countries. But India has argued that since Indians don’t get the same facilities in the US, there is no reason for US diplomats to enjoy the same facility in India.

Harf was responding to questions about the withdrawal of certain privileges given by India to US diplomats in the country after the arrest and the alleged inhuman treatment of Devyani Khobragade.

So, why does the government not arrest them?” he asked.

New Delhi: Among all the indignant voices against the treatment meted out to Indian diplomat Devyani Khobragade in the US, BJP leader Yashwant Sinha stood out with his demand that the government punish US diplomats in India having samesex companions as homosexuality was illegal in the country.

“Media has reported that we have issued visas to a number of US diplomats’ companions. ‘Companions’ means that they are of the same sex. Now, after the Supreme Court ruling, it is completely illegal in our country, just as paying less wages was illegal in the US. So, why does not the government of India go ahead and arrest them and punish them,” Sinha said.
Sinha, a former foreign minister, pointed out that while many focused on his remark about Section 377, his attempt was to bring out the issue of legality or law of the land. “My view is irrespective of Section 377. But the point is, as of now it is illegal. The law is still against same-sex relationships. Whether it should be there or not is another question. So, following the rule book, since same-sex relationships are illegal in this country, those diplomats who are into it should be arrested, just as those in the US paying less wages are in the wrong following the US law,” he said.

New Delhi: Indian aviation authorities — long upset at the lack of reciprocity in privileges given to US diplomats here and denied to desi diplomats in the US — have made their displeasure known to Uncle Sam.
The US Trade Development Authority had organized a farewell dinner for outgoing aviation secretary K N Shrivastava and DG, civil aviation, Arun Mishra on Tuesday at the US embassy club here. Both stayed away.
Aviation minister Ajit Singh too expressed displeasure over the treatment handed down to Devyani Khobragade. “It is for MEA to decide on steps to be taken. I am working for reciprocity in treatment at airports. Indian dignitaries have to pay to use airport lounges in the US and other countries like France. In India lounge access to diplomats is free. This is being relooked,” Singh said. He has sought re-examination of the entire array of privileges at airports — like airport passes to allow embassy staffers to receive dignitaries in both countries, lounge access and security checks.

New Delhi - As the India-US standoff over the humiliation of diplomat Devyani Khobragade worsened on Tuesday, the ministry of external affairs instructed Delhi Police to remove pre-cast concrete dividers and barricades outside the US embassy here.

These were part of the embassy's security cordon. Issuing instructions to police, MEA said: "The Indian embassy in Washington had a dedicating parking area for diplomats there. Despite requests that lot was not returned to the Indian embassy and thrown open to public. The barricades on Nyaya Marg be removed as a principal of reciprocity." Sources later said the US had taken away the dedicated parking area in Washington this January.

Delhi Police JCBs removed the dividers from Nyaya Marg and Shanti Path Lane and around 6pm opened the road for public.

ACP (Traffi c) Anil Shukla supervised the operation. On Tuesday morning, MEA, MHA and Delhi Police officers met and decided that the barricades around US embassy would be removed. The final MEA clearance came around 4.30pm. The US embassy had exclusive access to Nyaya Marg, which has the main embassy building and annexe. The embassy has been under threat from al-Qaida, Lashkar and other terror groups.
Security at the embassy remains unchanged and two PCR vans would remain in position, regular patrolling will continue

Lot of facilities given to these US diplomats in india..which they DONT DESERVE

Treat every diplomat as a common man.. specially they need to be strip searched every time they land on Indian soil... Does not matter what position that diplomat holds.. they have to undergo the similar experience so that the US of A understands how to treat people in the right fashion... Take away all facilities given to the US of A diplomats and treat them like a common man.......It should have been the same at a level of security provided to Indian mission in US

If this done with obama or any high minister from US in any country will they keep silence !

I ask you if the same treatment done with the US diplomat then wat their reaction will be.... calling for some UN meeting putting sanctions ?

this would be a side note in India if there was not a general election coming up in that country.... India and the USA will survive this minor news story ...they are far too important to each other to not to and as i said you cherry picked the extreme crimes for one nation and put a coat of white paint on the other to make it look better...not fair comparison by any stretch of the imagination

but the only anger is that she should not be humilated-- arrested in public place.

They should have been called her to surrender.....(though she got bail and released soon)

and Me itself against those lots of facilities/security given to US diplomat(which they dont deserve)..because of this the common people face lot of problem.

and now when india removes security barriers in front of the U.S. embassy ..

The embassy has been under threat from al-Qaida, Lashkar and other terror groups.
Security at the embassy remains unchanged and two PCR vans would remain in position, regular patrolling will continue

and now US says they reviewing arrest of diplomat...

I think a Diplomatic Storm is Brewing .... If Both Parties Don't handle this " Diplomatically " Soon Enough - its Only going to get Ugly and Worse...

if they had called her in to surrender she would not have done it...she would have gone back to india... and again why should any law breaker get an easier time just because they are a diplomat or a celebrity...and in fact...the diplomatic immunity laws are taken very seriously by countries so when they do actually do something like this id is for more than just something to do or embarrass someone..if this person is whining about how they were treated i have no sympathy what so ever and nor should you because the driving force for them should have been to NOT COMMIT THE CRIMES in the first place...not get all indignant and say look how those bastards treated me..all i did was break the laws and i should be allowed to do so just because i am special...

on a side note i have been to Cuba and many other Caribbean countries a lot and have always seen tourists from all over the world there...many of them act very bad and even break the laws ..bad enough to get arrested and even then the police gave them the opportunity to walk away but the prevalent attitude was screw you i am a citizen of (fill in the blank) and can do what i want...i see that attitude in this particular indian diplomats actions

az US cant dare or think to make their ties bad with india or else economically they will be suffer badly,, plus in south asia or i will say in whole asia only india have good ties/relation with US .. nor russia,china,pakistan,iran,korea so and so....

Even if she did commit this crime as said by US police, there is no way you can do cavity search and all that stupid behavior with a diplomat. This shows how hypocrite they are. Expecting immunity for their diplomats and doing this nasty stuff to other diplomats.

you do the crime you get treated like any other criminal once arrested...get over it... you cannot allow contraband to enter a jail no matter who brings it in... i have a close family member that works for the prison system in Canada and you would be amazed at what people try to conceal in body cavities....once again being diplomat gets you certain privileges that the common person does not get...but once arrested that all goes by the way side and rightly so and for very good reasons.... bottom line is several laws were broken here by a diplomat and she is guilty as hell too;;; and she is all indignant because, in her words she is a diplomat and should be allowed to break those laws according to her ans do so with impunity...not her government by the way with this attitude..this will all blow over soon and she will most likely not serve a single day in jail

you are also missing the big picture here...she broke the laws she knew she was doing something not morally wrong but also was against the laws in all civilized countries... but took the attitude i am better than all others and i can do it just because...that is the real crime here and you are glossing over that...it is what it is and she is getting what she deserves... you saying she should get different treatment just because she is who she is is totally not seeing this for what it is and does nothing to show this diplomat she did anything wrong

so it is ok to break laws and do as you please just because you are a diplomat....or is it for any other reason??? sh has admitted to these crimes and has said she should be allowed to do these crimes because she does not get paid enough.....you should be more upset that one of your diplomats has done such things...you clearly are not wanting to look this objectively and all because you want to hate the usa
